At the end of the day, his support payments will be calculated into a total arrerage calculation.  He will eventually be required to pay you.  If you're still not receiving money, that's rather troubling.  There are plenty of folks that speculate the system is completely corrupt.

Thank you for that. I wonder if their way around that is because he doesnt actually see the judge. He comes in a few months in a row then they might skip a month or two then bring him back. But he only meets with the trustee in a room at a table never with the judge. When I had my case first transferred I found out about it and went in and I dont think the trustee appreciated that. He was like can I help you? This meeting is for him? But I've always gone when my case was in different counties. Its weird that that haven't brought him to the judge. The secretaries just say they are doing all they can and the judge won't do anything and I should go through the state.

In Kansas, all family law issues are civil cases and follow the rules of civil procedure.  Of course each court can have their own "local rules" in how they conduct daily business, but state law requires parties of a case to be notified.  This is called "service."  Take a look at www.kslegislature.org and look at state statute 60-206.  Attorneys can only have an "ex-parte" hearing if there is an emergency.  Otherwise, there should be a motion filed in the case, all records kept (which you can obtain from the court) and a docket held to schedule the hearing.  Also, pursuant to chapter 60, they must notify you 7 days in advance of the hearing.  10 days if it is sent US mail.

Has anyone had any experience with McPherson county trustee's office? They aren't sending me any paperwork to notify me that they are having my ex come in. I get nothing. They also don't enforce. They said the judge just doesn't do anything and I should go through child support services. Ok but then is the same judge involved then too?

I would categorize this as a direct expense simply because it is paid directly to a 3rd party for participation in something.  However, since you don't have residency, the parent receiving child support is financially responsible for both indirect and direct expenses - all of them.  So, regardless of the categorization of the expense, the parent responsible for direct and indirect expenses would have to pay for it.


The only gray area is what you've eluded to.  Your ex may content that this expense is in addition to child support.  For that answer, I will direct you to the child support committee minutes which state that "all" expense are included in the tables.  That's because the data on which the guidelines are based include all possible expenses for a child on an average basis.  Exactly as you mention, nearly all kids take driver's ed regardless of income.  It's essentially considered part of the school curriculum these days and could even be considered a school expense.  In my book this is a very normal/typical expense.


I believe BMull who owns eFamilyTools has written an article about direct expenses on their blog.  See https://efamilytools.com.  I'd say there's plenty of case law and other data on the subject to show that this expense is already considered in the tables.  Brian Mull can probably guide you further if you need.

My ex and I have joint legal custody of our last minor child.  We do not share parenting time 50/50 and as a result my child support is higher than a 50/50 arrangement.  The child wants to take a Driver's Education class and I'm trying to figure out if this is considered an indirect expense. 

I have reviewed 2016 Kansas Child Support Guidelines and this appears to me to be an indirect expense covered under "transportation", but it does not explicitly mention costs of Driver's Education anywhere in that document.

Seems to me that as the child get older and I'm paying the higher rate for the child that this would be included.  In addition, it is very common for a child of someone in our combined income bracket to drive a car.

So would Driver's Education be an Indirect Expense that I would have already paid for as part of my portion of Child Support?

It sounds like you're doing your own diligence which is awesome!  I wish more folks did that to gut check the numbers.  In the end, remember that you're bound by the guidelines - even if the guidelines don't make sense.

Basically what I'm coming up with is with the Shared Expense Formula, my child support is significantly higher AND I pay half of all of the direct expenses as compared to the Equal Parenting Time Worksheet adjustment, with it the child support is approximately 50% less AND I don't pay any direct expenses.  This seems completely backwards to me.

I've run into all kinds of things that don't make sense.  Can you or some other kind soul look at some worksheets that I've filled out and see where I'm going wrong.  Perhaps via email and out of public eye?  It seems as if the more support I offer, the more it forces me to pay. That or I'm really not understanding something.
