modification/summer visit adjustment
« on: June 11, 2013, 10:18:06 PM »
My ex husband has custody of our kids. State wants to increase my c/s to $1000/month. My kids are staying with me for the summers for now on and when the attorney called to verify this with my ex, she told him she would be checking into it and it would've been nice it we told her before the paperwork was filed. My first question, what does she mean, she will be checking into this? Is she going to drive by my house? Why would she even say that? My next question is, how much will this modify my support? I'm excited to be with my kids all summer but it they still do the $375increase, I'm gonna be working a second job. That's not spending time with my kids. Thanks

To my knowledge I've never heard of an attorney driving by a home to check on parenting time.  I think what she means is that she will have to calculate some numbers to figure what adjustment would be appropriate for summer parenting time.  Sometimes child support is adjusted based on an annual sum of child support amounts - if you have the kids for 3 months and he has them 9 months, child support would be reduced to 9/12 of the original number.  Or, sometimes child support will flip flop.  So you pay him for 9 months, then he pays you for 3 months.  Personally, I would request the later.

I hope that answers your question.

Read the child support guidelines as there are a couple scenarios I believe which assume summer parenting time.

They gave me an adjustment of $138/mo. As much as I would've liked it to have been more and thought it would be more,  I'm happy there was some relief . Thanks for your help.

So you are now paying $862/mo?  What would it have been without the adjustment?  Do you know how the adjustment was calculated?  I'm curious what the rationale was behind the $138 (if there is any).  This could help other members.

I was paying $675/mo and they wanted to increase it  to $1043 and the summer adjustment made it $913. Three kids age group 12-18.

That number sounds a bit low.  When they are with you during the summer, are they with you 100% of the time?  If we say you have them for all of June and July,  you should maybe get a 2/12 reduction, which is $173.  Not sure why the number is low.  Did anyone tell you how it was being adjusted?  Someone should have that on file.

Nothing was explained to me, just said they would send me paperwork and IT would have 10 days to dispute it. I have the kids from May 11-August10. Kids will go to dads every other weekend.
