It appears more and more that the custodial parent in our case is going to move to the West coast. She would be doing so to be with her boyfriend who just moved. She has been denying that he is her boyfriend even though she has been staying with him (with the children) more than 50% of the time and sleeping in his room with the door shut (according to the children). Now that he has moved, she has flown up there to spend the weekend and informed us today (didn't ask.. she informed us) that she is taking the kids to the west coast for their spring break. Two visits with this non boyfriend in the month since he moved. Keep in mind that she recently texted us to tell us to hurry up and send child support "so the children can live." Anyway. It really looks like she might be considering a move out of state taking the three children away from their father, their grandparents, their cousins, their half siblings.. their school and all that goes with that. It does not seem like this should be legal. If she chose to move out of state and the children came to live with us, they would be leaving their school and friends; but still have constant contact with other family; however, we're not sure what it would take to have this happen. Things we have read online say that the custodial parent has to prove that the move would be in the best interest of the child and not for her own benefit soley... but it seems the mom always "wins" anyway. Have any of you had any experience with this?
