Modification question
« on: September 18, 2014, 08:47:50 AM »
I have a 9 year old boy that I have been paying CS on his entire life and spend almost 50/50 time with. His mother, my wife and I have all become closer over the last few years. The almost 50/50 time is a new thing, within the last year, and I am planning to send a motion for modification but I have seen cases were the parents work out an amount that is both doable and feasible to all parties involved. My question is, does anyone know how receptive Kansas is to this kind of agreement?  I just feel that after reading other peoples hardships with their co-parent that I have this opportunity because my sons mother and I communicate very well and I have been helping her recently with financial decisions.

On the issue of Child Support it is my understanding that the Court MUST consider an agreement between the parents as submitted to the Court for consideration. But, is also under obligation by law to make sure that agreement adequately provides for the child and may modify it.

With custody, there is a statute that says the court will assume a custody agreement is in the child's best interest.  To my knowledge there is no such statute regarding child support.  There are different points of view on this particular topic and I've heard it both ways.  Essentially as long as both parties agree to the child support amount and demonstrate to the judge that one parent is providing something to compensate for the adjustment, he/she should sign off on it.

Can you share the numbers with us?  We probably don't need exact numbers, but are you paying $1000 now and want to change to $100 or is this a much smaller change?  Essentially, is the potential hassle worth the effort?
