Change of Job & Insurance question

I am responsible for carrying the insurance for my child.  If I change jobs, lose my insurance (for say 90 days) till I can have insurance with the next company, what happens?  I notify the courts and then what?

I believe companies are required by state law to offer COBRA insurance.  Instead of the company paying most of the premium, you can keep the same plan but pay the company portion (quite high).  Or you could get other insurance.  Or, of course, you could live on the edge and go with no insurance for 90 days.  The biggest problem you'll run into is that your court order probably says that you are obligated to provide the insurance.  It doesn't say what kind of insurance, just insurance.  Maybe a very cheap major medical plan for the kids for 90 days would suffice.  It's not my place to advise you on what kind of insurance you should/shouldn't buy, but I think the courts "could" hold you accountable if you're supposed to provide the insurance.

I wouldn't chance 90 days without insurance if I could help it but I can barely afford things as it is.  I'm not sure what a temporary policy would cost but I have to believe it wouldn't be cheap.

Let me throw this at you.  My insurance, with my company, has a ridiculously high deductible.  I'm required to be the primary.  I think the mother carries insurance, when she has it, as secondary insurance and likely often makes up for the parts my insurance lacks.  If I were completely without insurance till my next insurance kicked in, would it satisfy the courts because the child is covered by her insurance temporarily?

Yes, I would believe so.  In fact, I think you have a strong argument that would be the most cost-effective option as well.  Of course you want to communicate this to mom so she knows she must maintain insurance until yours kicks in.  Written communication which is sent certified mail return receipt is usually best for things like this.

The Court Order requiring you to insure your children is likely not to require any specific type of insurance. You must inform the other parent of the change and not the Courts. The Courts would only get involved if the other parent files  for a hearing on a violation of the Order, i.e. contempt.

If you are eligible for COBRA you may be eligible to purchase a plan that limits coverage to your dependents.

FYI GURU in the case where someone is fired from a job they can not qualify for COBRA insurance. I would check out the Obamacare plans offered for those with a change of status mid year. Child insurance plans are available also.
