Hello all,

I appreciate your help in advance. 

I have a 5 year old child I'm paying an enormous amount of child support on.  I pay the insurance as well and the mother is supposed to pay for daycare.  In the child support worksheet the figure is $600/month for daycare. 

When my child goes to 1st grade or school full time could my child support be reduced if the child is in school rather than care during the day?  Assume the length of a school day is equal to the amount of hours formerly spent at a daycare.

Yes!  I would imagine daycare costs will decrease significantly to more of a latchkey type program rather than full-day daycare.  Child support is figured based on both of your incomes and then daycare fees are stacked on top of that to arrive at the final number.  If something changes in any of those values which would cause your child support to change by more than 10%, you are allowed to ask the court to adjust it.  Whenever your child's last day of daycare is, is when you would want to have the order effective.  So, you may want to file to decrease a little earlier.  Also, by the newest KS statutes, an order of child support does not become effective until 30 days after filing of the motion to change it.  You may want to check with your attorney on when you need to file though.
